We, Us, Our means X-Active Gym.

X-Active Gym values the privacy of our members and anyone who visits our website. We are committed to maintaining your confidentiality and protecting your information.

This privacy policy sets out the personal information we collect from you.  Personal information has the meaning given to that term in the Privacy Act 1988 (Cth).  This policy also outlines how personal information is collected by us and why we collect it.  This policy may be amended or updated from time to time.

By visiting our website or social media pages (together, our Sites) or using our gym you agree to the terms of this policy.

 


The personal information we collect


We collect personal information so that we can provide our services to you. Personal information that we collect includes:

identity information such as your name and date of birth;

contact information such as your residential address, work address, phone number (home and/or mobile), email address and emergency contact information. We may also ask for your preferred method of communication; and

bank details and/or credit card details.

In the course of generating your membership, we may create new information about you which is considered personal information. This can include your membership reference and preferences in respect our facilities and services.

We specifically collect sensitive information in respect of your health, whether you are on medication, if you have any underlying medical conditions, and similar types of health information.

As we allow minors (people under the age of 18) to use the gym in some instances, we may collect their personal information too. In these instances, we will always ask for a parent or guardian to review and approve the personal information being disclosed.

We take identification photos of all gym members. The photos will be associated with your unique gym membership.

When you use our Sites or contact us, we collect, store and use the personal information that you disclose. This includes details such as your name, address, telephone, fax, email and mobile phone number as well as traffic data, location data, web logs and other communication data.  Some of this data is collected automatically.

We use closed circuit cameras in our gym for health and security reasons. If you have any queries in relation to the use of such cameras, please contact us.

We may also collect and use the personal information you provide while using our Sites including health, training and dietary information.

We may also collect and use personal information you provide through our Sites when you enter competitions, promotions or events. Such information may include photos and comments.  If you provide personal information to us through our Sites, your personal information will be handled in accordance with this policy.

 


Why we collect personal information and how we use it


We use personal information to provide our services when you request them from us, for example to manage your membership, communicate with you and help you to book classes or appointments.

We may use personal information to provide and improve our services, in particular when you have provided feedback to us.

We will use personal information to assist in processing payments, allowing you to access the gym, to prevent crime and aid in the prosecution of offenders and to comply with the law. Personal information helps us to improve our platform and prevent or detect fraud.

We may occasionally use your personal information to send you promotions or advertisements that we think will be of interest to you. We may also use it to send your surveys about our services.  You are always entitled to opt out of these services by notifying us.

We use the sensitive health information provided by you so that we can determine whether is appropriate to allow you access to the gym and certain classes. We will always seek your consent before asking this information.

We do not control how social media platforms use your personal information. You should always read the privacy policies of those platforms before entering your personal information.

Other than as set out in this policy, we will not share your personal information with third parties.

 


When we may disclose personal information to a third party


Our personnel, including staff, group fitness instructors and personal trainers will have access to your personal information to the extent that they need it. They will treat it in accordance with this policy.

We engage other parties to provide services for us. An example of this is our third party payment provider and our marketing agency.  They may need your personal information in order to facilitate the provision of our services to you.

We use third party technology providers for the purposes of hosting, storing and securing information and data. These providers will have access to your personal information in order to perform their functions.  They must process your personal information in accordance with the Privacy Act 1998 (Cth).

We may send promotions to you from our partners and affiliates. We do not give those partners or affiliates your name and address or any of your health information or other sensitive information.

In the event that we are sold, or our assets are sold, your personal information will be transferred to the acquirer.

We may be obliged disclose to your personal information if we believe that such a disclosure is appropriate to:

comply with law;

comply with, or enforce, obligations under your agreement with us;

protect the rights, property or safety of us or our others.

Disclosures under this clause 3.6  may include information sharing with companies and other organisations such as credit reporting agencies in order to prevent against fraud and reduce our (or others) credit risk.  We may also share information with police or other government authorities.

We may also ask for your consent to disclose your personal information. You can always say no when we request this.


Automatically collected information


We use tracking technologies such as cookies or web beacons to make your use of the Sites and services as convenient as possible. Cookies are pieces of information that a website transfers to a computer’s hard disk for record keeping purposes.  Web Beacon is a technical method that sends information related to the access to websites, when you browse websites, open or preview an HTML-formatted email.  Most web browsers are set to accept tracking technologies such as cookies or web beacons.  These tracking technologies do not themselves personally identify users, although they do identify a user’s browser.  These tracking technologies allow us to monitor our Sites, and to record how many people are using the different parts of the Sites.

It is possible to set the browser to refuse tracking technologies such as cookies or web beacons, however, this may limit the services provided by our Sites.


Information security


We take all reasonable steps to keep personal information secure, accurate and up to date. The personal information is stored on secure servers if in digital format, or in locked areas if in hardcopy format.

In some cases these facilities may be in Amsterdam, Isle of Man, England and the United States. Our employees and data processors are obliged to respect the confidentiality of any personal and/or sensitive information held by us.

We only permit authorised personnel to access your information and information will only be disclosed to third parties in accordance with this policy. We destroy or de-identify personal information when we no longer need it.


Third party links


Our Sites may provide links to other websites.  These linked websites are not under our control, and we are not responsible for the conduct of those companies.  We cannot guarantee for the performance or otherwise of any content and/or software contained in such external websites.


Your rights


You are never obliged to provide us with your personal information, however, if you do not provide us with the personal information we ask of you we will not be able to grant you membership.

If you do not want to receive e-mail or other mail from us, you can click unsubscribe or let us know in writing.


Your personal information and complaints


You may request access to the personal information we hold about you by contacting us using the details set out in section 9 of this policy. We will respond to you within a reasonable timeframe.  Typically we will provide you with the personal information we hold about you.  However, in some circumstances it may not be possible for us to provide you with access to all of your personal information.  In these cases, we will let you know and explain why.

If you believe that any of the personal information we hold about you is inaccurate or incomplete, you must contact us using the details set out in section 9 below to request that we correct the information.

If you wish to make a complaint about our handling of your personal information, please contact us with your name, two forms of contact details and your complaint. We will respond to you within a reasonable period.  If we cannot to resolve your complaint, you may wish to contact the Office of the Australian Information Commissioner.
